This Privacy Policy explains how Visual Spectrum Studio Ltd (“Visual Spectrum,” “we,” or “us”) collects, uses, and discloses information about you. We may collect information about you in several ways.  These include:

  • when you sign up for a course

  • when you subscribe to our services or mailing list

  • if you submit your details when sending an enquiry through a third-party vendor

  • when you provide details via messaging apps

We may also collect information about you if you consent to the use of cookies when using our website.

The information we collect:

The information we collect can include your name, email address, payment details where relevant, IP address, geographical location of where you accessed our website, information about how you use/interact with our website, information from cookies (if you have consented to their use) and information about your computer or other electronic device (tablet and browser type). 

How we use your information and the legal bases for this:

Your information is used to process your purchases, deliver our services, and contact you, as well as to improve the website experience for our users. In these instances, we process your personal data because it is necessary for the performance of a contract with you, or to take steps at your request to enter a contract.

Following your purchase, we may subsequently send you communications about selected Visual Spectrum products, courses, and services. In these circumstances, the processing of your personal data is based on legitimate interest. 

When you opt in to receive communications from us, this processing is performed based on your consent and you can remove your consent at any time. Within each communication we send, you have the option to opt out of further contact.

Who we share your data with:

Visual Spectrum won’t transfer information about you to third parties for the purpose of providing or facilitating third-party advertising to you. We won’t sell information about you to a third-party.

Payment Processors:

Visual Spectrum provides Services in conjunction with several payment processors, including: Stripe and PayPal through which users may pay for Visual Spectrum courses, content and products. Those companies acting as payment processors may collect and store personal data related to your billing information and history in order to provide their services, and may collect and store personal data and business data to prevent fraud and other abuse.

To delete your payment or billing information, you will need to do so with your payment provider, as Visual Spectrum only has minimal secure access to those records as needed to provide the Services.

Third-Party Embeds:

Some of the content that you see displayed on Visual Spectrum is not hosted by Visual Spectrum. These “embeds” are hosted by a third-party and embedded in a Visual Spectrum page, so that it appears to be part of that page. For example: YouTube or Vimeo videos or SoundCloud audio files. These files send data to the hosted site just as if you were visiting that site directly (for example, when you load a Visual Spectrum page with a YouTube video embedded in it, that video appears because of a pointer to files hosted by YouTube, and in turn YouTube receives data about your activity, such as your IP address and how much of the video you watch).

Visual Spectrum doesn’t control what data third parties collect in cases like this, or what they ultimately do with it. So, third-party embeds on Visual Spectrum are not covered by this Privacy Policy. They are covered by the privacy policy of the third-party service (so, when you watch a YouTube video embedded in a Visual Spectrum page or post, the use of data about your interactions with the video would be covered by YouTube’s privacy policy).

Tracking and Cookies:

Some third-party services that we use to provide the Service, such as Google Analytics, may place their own cookies in your browser. This Privacy Policy covers use of cookies by Visual Spectrum only and not the use of cookies by third parties.

Visual Spectrum respects your data and has taken appropriate technical and organisational measures to ensure we have mitigated against such risks as loss or unauthorised access, destruction, use, modification, or disclosure of data.

Data Retention:

The length of time we retain it will depend on any legal obligations we have (such as tax recording purposes), the existence of your consent or our legitimate interests as a business.

When you purchase from us, for example your purchase a course or digital download we retain that information for a period of six years following the end of the financial year during which you purchased from us. It is our legal obligation to keep these records for tax purposes. 

Your Rights:

Subject to certain limitations, you have the right to:

  • Request a copy of the information we hold about you and be told about its use.

  • Request that Visual Spectrum rectifies or deletes your information or restricts processing if you have concerns over its accuracy, deletion, or fair and lawful use.

  • Withdraw consent to the use of your information. All our communications (excluding operational communications) contain an unsubscribe link.
